For driver safety. Hours-of-service regulations were established by the FMCSA to guarantee CMV drivers enough rest to prevent driver fatigue. The ELD mandate requires that fleets and drivers use a certified electronic logging device to capture those hours.
“Hours of service” refers to the maximum amount of time drivers are permitted to be on duty including driving time, and specifies number and length of rest periods, to help ensure that drivers stay awake and alert. In general, all carriers and drivers operating commercial motor vehicles (CMVs) must comply with HOS regulations found in 49 CFR 395.
ELDs are the devices fleets use to capture accurate driver hours and ensure ELD compliance. The FMCSA requires most commercial drivers to use one instead of paper logs for accurate hours-of-service compliance. But it doesn’t always work because not all electronic logging devices are the same. Some types help you avoid more violations than others.
In the United States, inspectors recorded 883 hours-of-service driver out-of-service (OOS) violations, accounting for 23.2% of all U.S. driver OOS violations during the 2026 International Roadcheck. And HoS violations ranked second in the top five violations for drivers. Penalties for HoS regulation violations apply to the driver and the motor carrier.

An electronic logging device is a driver hours tracking and fleet management technology used to digitally capture accurate driver hours and make drivers’ RODS available during roadside inspections. The vehicle’s on-board telematics device captures live engine data, including vehicle movement, engine hours and miles driven. ELDs are required because accurate driver hours and on-demand RODS availability are both must-haves for ELD compliance. Usability failures show up as HoS violations even when the device and software are sound. Before committing, put the device in front of actual truck drivers, including ones who are not naturally comfortable with technology.
Look at:
Hardware fails. Trucks lose power. Drivers forget how to log a malfunction correctly at 4 a.m. on a Tuesday. How a vendor handles these moments says a lot about the total cost of running the system.
